Terms of Service
The agreement between you and ELAV8 AI LLC for using Just Say It. Short where it can be, specific where it must be — above all about recording.
By using Just Say It — the website at https://justsayit.ai and the product at https://justsayit.ai/app — you agree to these terms. “We” is ELAV8 AI LLC, 1343 Main Street, Suite 205, Sarasota, FL 34236, United States. If you use the product for an organisation, you confirm you may bind it, and our Data Processing Addendum forms part of these terms for it.
1. The service
Just Say It composes a slide in real time from a live conversation, answers out loud, keeps the notes, and keeps each conversation for the account that started it as a replay, a deck and notes. It runs in a current desktop browser with a microphone. What it does is described on the home page and in the changelog; what it does not do is not promised. Just Say It is for people 13 and over; an account is for adults, 18 and over. A child under 13 may take part only when a parent or teacher is the person who starts the meeting, present and responsible for them — the host, as section 4 says.
2. Accounts and the trial
- The first ten minutes need no account. Trials are limited; a trial’s recording is kept for one hour and becomes yours if you sign in within it.
- Beyond the trial you sign in with an ELAV8 account, whose own terms apply to the account itself. You are responsible for what happens under your sign-in; tell us if you believe it has been used without you.
- You must be 18 or over, and able to form a binding contract where you live, to hold an account.
3. Plans, minutes and payment
- Free: 90 minutes a month, rooms of two (you and one guest), and two welcome meetings — the first two times a third person joins a Free account’s room, that meeting opens to up to thirty people at no charge. Pro: $19 a month, or $15 a month billed yearly ($180 a year), for 600 minutes a month, rooms of up to six people and unlimited history. Team: $29 a month for each seat, or $25 a month a seat billed yearly ($300 a seat a year); you choose the number of seats at checkout and can change it in the customer portal; each seat adds 1,000 minutes a month to one pool the whole team shares, everyone in a room the account hosts draws on that pool, rooms of up to thirty people, and the same blocks as Pro apply when the pool runs out. Prices are in U.S. dollars and may change with notice; a change applies from your next billing period.
- A minute is a minute of your own microphone in a live session. In a room on Free or Pro each participant’s minutes count against their own plan; in a room a Team account hosts, every participant’s minutes count against the host’s pool and nobody the host invites needs a plan of their own. When a Team pool runs out during a meeting, the meeting may continue for up to ninety minutes while the host adds minutes; after that it pauses for everyone in it until minutes are added.
- When a Pro or Team plan’s minutes run out during a month, you may add a block of 100 minutes for $5, charged to the card on file. Nothing is charged until you have agreed to a block: the first time, the product asks you. If you tick “Do this automatically from now on” when you agree, or turn on “Add minutes automatically” in your plan settings, every later block is added and charged without asking you again whenever the minutes run out, until you turn that choice off at any time in the same place; the checkout and the settings switch describe the same arrangement. At most four blocks are added in a month. When no card is on file, or a charge fails, the session stops when the minutes do.
- Films and video memes. After a meeting the host may have a short film made of its slides; during a meeting the host may turn on video memes — five-second clips starring one person in the room who said yes to being in memes. A film is priced at $5 a minute of film and is PREPAID: you buy credit first, in tranches, each charged once to the card on file when you choose it; a film is quoted to you in dollars before it is made and is charged against your credit only when it is on the screen — a film that is not made costs nothing. A free account has one free film for life; Pro has three a month; films on a Team plan are included and are not charged. A video meme is priced per clip in cents, shown in Settings → Memes before you turn them on, and charged against the same prepaid credit only when the clip is on the screen — within a monthly budget you set there; when the budget or the credit runs out, memes carry on as pictures. Unused credit does not expire while your account is open; it is not refunded, and if you close your account the credit left on it is forfeited — unless the law where you live requires otherwise. People can star in a film in two ways: by agreeing on their own screen when the film is planned, with their own picture and, if they record a line, their own voice — which they may withdraw before the film is made, and whose files are theirs to delete from the film card — or because the host added them to the host’s cast with a photo and, if used, a voice sample, stating as they added each one that the host is that person or has that person’s permission. A host who adds another person’s photo or voice warrants to us that they have that person’s permission for its use in films and pictures, is responsible for every use the host makes of it, and will indemnify us against a claim by that person or anyone else arising from its use without such permission; the host’s statement is not the person’s consent to us. Anyone who appears in a film, meme or picture made here without having agreed may write to [email protected] and we take it down. Every film, video meme and picture the product makes carries a small “AI-generated” mark; you may not remove or hide it, or present such a film or picture as a real recording.
- Payments are processed by ELAV8’s billing service. A paid plan renews automatically at the end of each billing period — monthly or yearly, as you chose — and is charged to the card on file, until you cancel. You may cancel or change your plan at any time from the customer portal (Settings → Plan → Manage subscription); a cancelled plan runs to the end of the period paid for and does not renew, and the minutes of a plan you paid for in a month stay yours until that month ends, whatever the plan is changed to. We do not send a reminder before a renewal; the portal shows your next billing date. Fees are not refunded for a partly used period unless the law where you live requires it.
4. Recording and consent
The product records every session: the transcript of what is said, the slides composed from it, and the notes — for the account that started the session. In a room, the words of every participant are transcribed and kept the same way.
If you start a session, you are the host, and you undertake: (a) to tell every person in the room, before they speak, that the conversation is transcribed and kept; (b) to obtain the consent of every person the law where they are requires — in a number of jurisdictions, California among them, the consent of everyone taking part is required; (c) to know and follow the law that applies to recording where you and your participants are; and (d) to delete a recording when a participant with the right to ask does. We provide the tools for this — an invite link, a door a host controls, a history from which any recording can be deleted — but the undertaking is yours, and you will indemnify us against a claim arising from a recording you made without the consent the law required. The undertaking covers every way words reach your session: the people in the room; the people on a call you add from another browser tab, whom the product cannot tell — before it starts you confirm on your screen that they will be told and that any consent the law requires has been obtained, and that confirmation is recorded; and the people whose words a shared screen’s sound carries into the room, for which the person sharing confirms the same before the first sound is heard.
The undertaking is the same when you send Ziggy into a meeting held on Google Meet and Microsoft Teams or Zoom, or invite [email protected] to one: Ziggy posts a notice in that meeting’s chat and says one line as it joins, and anyone in the meeting may remove it, but you are the one who tells the people there and obtains the consent the law where they are requires; the meeting’s words are transcribed into your conversation’s record while it is there. Its minutes count against your plan like your own; Pro sends one at a time, Team three.
A participant who joins a room accepts that their words are transcribed by an AI co-presenter and kept by the host, and that a picture of their face is kept only by their own choice on their own screen, or by the host under the host’s responsibility; a participant who does not accept this should not join. The card every participant sees before joining says so above the button, every screen in the room shows a “Transcribing” indicator while anyone is on the air, and a guest sees a notice on their own screen while it is transcribed — these help you meet your undertaking; they do not replace it where the law asks more of you. If you use the product with employees, you are responsible for any workplace-monitoring notice the law where they work requires; we do not give that notice for you. If you use it at work as an employee, your employer may be the host, and that notice is the employer’s to give.
5. Your content
- What you say is yours. The slides, notes, memes and films the product composes from it are yours to keep, use, share and delete as you wish; we claim no ownership in them, and we make no promise that something a machine composed is protected by copyright where you are. You grant us the licence needed to run the service for you: to transcribe, compose, store, replay and answer from your recordings, and to have the service providers described in the Privacy Policy do so on our instructions.
- You are responsible for what you say and show, and for having the right to say and show it — including a photo or a voice you add to your cast, and the pictures the product fetches for the slide from public collections under their licences.
- We do not sell your content and we do not hand it to anyone else to train on. We may use the records of conversations — the text and the product’s own decisions about it, never audio, a face or a voice — to tune the models we run ourselves for this product, as the Privacy Policy says; a conversation you delete is gone from that material too.
6. Acceptable use
- Do not use the product to record people without the consent the law requires, to harass or defame, to infringe another’s rights, or to break a law.
- Do not use a film, a meme or a picture the product makes to make anyone appear to say or do something they did not in a way that could deceive, to impersonate anyone, or to make sexual or demeaning material of a person; do not add a photo or a voice of a person who has not agreed, and never of a child; and do not remove or hide the “AI-generated” mark the product puts on what it makes, or pass it off as a real recording.
- Do not probe, overload or interfere with the service, or use it to build a competing dataset of its outputs.
- Do not share a room’s invite link or your sign-in with people you have not chosen to admit.
- If you believe something kept or shown here infringes your copyright or shows you without your agreement, write to [email protected] with the link and what is yours; we take down what is shown to infringe and tell the host, and a host whose material is taken down may reply to us.
- We end the account of a person who infringes repeatedly.
- We may suspend or end an account that breaks these terms, after telling you unless the law or the harm forbids the delay.
7. Our property
The product, its design and its method are ours. Patent pending · U.S. Application No. 19/815,400. The name Just Say It, the wordmark and the icon are ours; the brand page says how they may be used.
8. Availability and changes
We work to keep the service up and publish its state on the status page, but we do not promise uninterrupted availability: the models and networks it depends on are not ours. We change the product often — the changelog records it — and may retire a feature with notice. If we retire the service, we give notice and time to export your recordings first.
9. Disclaimers
The service is provided as it is. The transcript, the slide and the co-presenter’s answers are produced by machines from speech in real time; they can be wrong, and you should not rely on them for a decision without checking. To the extent the law allows, we make no warranty of merchantability, fitness for a purpose or non-infringement.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for loss of data or profit, arising from the service; our total liability for any claim is limited to the fees you paid us in the twelve months before it arose, or one hundred U.S. dollars if you paid none. Nothing here limits a liability that the law does not allow to be limited.
11. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and disputes are brought in the state or federal courts of Sarasota County, Florida — unless the law where you live gives you a right to bring them at home, which these terms do not take away. Before either of us goes to court, we talk: write to us and we will try to settle it first.
12. Changes and contact
We may change these terms; the date at the foot changes, and a material change is announced in the product before it applies. Write to [email protected] or to ELAV8 AI LLC, 1343 Main Street, Suite 205, Sarasota, FL 34236, United States.
