# Creator Program Terms

> The terms for creators in the Just Say It creator program: who may take part, what counts, how views are verified and paid, the budget and the stop switch, disclosure, rights and taxes.

## 1. The program and these terms

ELAV8 AI LLC (“we”) runs the Just Say It creator program. These terms are the Creator Agreement: you accept them when you accept our approval, and they apply to every post you register with us. The [Terms of Service](https://justsayit.ai/terms) apply to your use of the product itself. Where the two differ about the program, these terms govern.

The creators page and these terms describe a program for approved creators. They are not an offer to pay anyone for a post. Payment is owed only under this Creator Agreement, which we enter into with you after approving you in writing, and only for posts registered and verified under it.

## 2. Who may take part

- You must be at least 18 and able to form a binding contract where you live.
- You take part only once we have approved you in writing. We decide which applications to approve; applying does not guarantee approval, and we may decline without giving a reason.
- One creator, one participation: your tracked link and your code are yours alone. Sharing them, or registering another person’s post, ends your participation.
- Posting about Just Say It, tagging us, or sending us a video without approval creates no obligation on either side.

## 3. What counts

- A public post on TikTok, Instagram or YouTube — Reels and Shorts included — made after your approval.
- On the brief we gave you, and honest (section 8).
- Disclosed as paid — in the video, with the platform’s own tool and with #ad (section 7).
- Carrying your tracked link where the platform allows a link.
- Registered with us within 7 days of posting, with the form on the [creators page](https://justsayit.ai/creators#apply) or as we tell you in writing.
- Kept up, with its disclosure, until at least day 30.

## 4. Views and how they are verified

A post earns for the views the platform itself counts in the first 30 days after posting. At day 30 you send us a screen recording of the post’s analytics showing those views; we check it against the public count and may ask for more evidence. Views from advertising you paid for, bought views, bots, view farms and engagement pods are never verified views. We decide in good faith which views are verified, and tell you how we counted. A post with fewer than 10,000 verified views earns nothing; a post that reaches 10,000 is paid for all its verified views.

## 5. Rates, bonuses and caps

- Starter: $2 per 1,000 verified views — the rate every creator starts on.
- Pro: $3 per 1,000 once your registered posts together pass 1,000,000 verified views; the rate applies to posts registered after that.
- Partner: $4 per 1,000 once they pass 5,000,000, and we offer you a monthly contract (a retainer and first look at briefs) on terms we agree in writing.
- Bonuses on one post: $250 when its verified views reach 250,000; $1,000 when its verified views reach 1,000,000 — each once.
- Caps: $3,000 per post, views and bonuses together; $5,000 per creator per calendar month, unless a Partner contract says otherwise.
- All amounts are in U.S. dollars. We take no cut of them.

## 6. The budget and the stop switch

- The program runs on a fixed monthly budget. Posts are paid in the order they qualify. When a month’s budget is committed, we pause new registrations for everyone until the first day of the next month; posts registered before the pause are paid under these terms.
- We may pause new registrations at any time.
- We may end the program, or your participation in it, with 14 days’ notice. Views already earned under these terms are paid.
- We may change these terms. A change is published here with its date and applies only to posts registered after it.
- You may leave at any time; posts you registered before leaving are paid under these terms.

## 7. Disclosure

Every post for the program must say clearly that it is paid: in the video itself, on screen and out loud; with the platform’s own paid-partnership tool; and with #ad at the start of the caption, where people see it without opening anything. Under the U.S. Federal Trade Commission’s Endorsement Guides a material connection includes the possibility of being paid — so a post made in the hope of being paid must be disclosed too. The [creators page](https://justsayit.ai/creators#disclosure) shows the setting on each platform. We look for the disclosure when a post is registered and again before it is paid, and we may ask you to fix a missing or unclear one; a post without one is not paid, and we may withhold payment until the disclosure is present.

## 8. Honest content

- Use the product for real before you post about it, and say only what you actually saw. A paid post is a testimonial and must reflect your honest experience.
- Make no claim about accuracy, speed, savings or results you did not see yourself, and none about another product beyond the facts on our [comparison pages](https://justsayit.ai/compare). No put-downs of other products or people.
- Do not call the product “patented” — it is patent pending — and say nothing about how it works inside.
- Nothing in these terms requires you to say anything positive. The brief and the disclosure are the only requirements.
- We may decline an off-brief post or one with a false claim within 7 days of its registration, with the reason in writing.

## 9. What is never paid

Bought views or engagement, bots, view farms and engagement pods — the post is forfeited and your participation ends; buying or selling fake indicators of influence is also against the FTC’s rule on consumer reviews and testimonials. Posts without the disclosure. Posts declined under section 8. Posts deleted, made private or stripped of their disclosure before day 30.

## 10. Payment and taxes

- We pay through a payout service. Before your first payment you set up an account with it, and it collects the identity and tax information the law requires; we never see your bank details. The tax forms the law requires of you — including any information return we or the payout service must file about what you earn — are a condition of payment; using a payout service does not remove any filing duty of ours.
- Payments are monthly, 15 days after a post’s 30-day window closes. A post under review for fraud is paid when the review ends, if it qualifies.
- You take part as an independent creator, not as an employee, agent or partner of ours. The tax on what you earn is yours.

## 11. Rights

- Your post is yours.
- You give us a non-exclusive, royalty-free licence to repost, stitch, duet and share it on our own channels, with credit to you, for as long as we keep it there.
- Running your post as a paid advertisement needs a separate licence, agreed and paid per post (our offer: $200 for 90 days).
- You confirm that you have the rights to everything in the post — the music, the people in it, the footage — for the uses above, and that everyone who appears in it has agreed to appear and to its reposting as described. You will indemnify us against a claim that the post used a person’s likeness, voice, music or footage without the rights you confirmed. If a person in a post we reposted asks us to take it down, we do, and we tell you.

## 12. Your information

We keep what you send us — your application (with the statement you ticked and the date of these terms) and your registrations — in files only the people who run the program read, and we write to you at the address you gave. The payout service holds your payout and tax details under its own terms. The [Privacy Policy](https://justsayit.ai/privacy) says what else applies and how to ask us to delete what we hold.

## 13. Liability and disputes

The limits of liability and the governing law and disputes sections of the [Terms of Service](https://justsayit.ai/terms#liability) apply to these terms too.

## 14. Contact

Questions about the program, a registration or a payment: [contact@elav8.ai](mailto:contact@elav8.ai), or reply to any mail from us. ELAV8 AI LLC, 1343 Main Street, Suite 205, Sarasota, FL 34236, United States.
